Other legal assistance matters

Extended Legal Assistance is available to complainants where NSW Police seek their counselling information when investigating sexual offences against them.

To be eligible for Extended Legal Assistance the applicant must satisfy:

  • Clear Benefit Test.

The ELA Means Test does not apply to these matters.

Extended Legal Assistance is available to applicants to claim and resolve disputes about Veterans’ entitlements.

Extended Legal Assistance is available to:

  • submit a claim with the Department of Veterans’ Affairs or the Commonwealth Superannuation Corporation or the Department of Defence (DFRDB Scheme), and/or
  • to seek internal review of a decision of the Commonwealth Superannuation Corporation or Department of Defence (DFRDB)
  • make a reconsideration request with the Department of Veterans’ Affairs
  • appeal a decision of the Department of Veterans’ Affairs to the Veterans’ Review Board
  • seek a waiver or write-off request of a debt, where there are special circumstances
  • seek compensation through the Compensation for Detriment caused by Defective Administration (CDDA) Scheme, where a person has experienced detriment as a result of the Department of Veterans’ Affairs actions
  • seek an Act of Grace, where there are unintended or anomalous circumstances resulting in payment ineligibility.

To be eligible for Extended Legal Assistance the applicant must satisfy:

  • Clear Benefit Test.

Extended Legal Assistance is available to workers who have disputes about unlawful discrimination and/or sexual harassment in the workplace.

Extended Legal Assistance is available to:

  • negotiate the resolution of unlawful discrimination and/or sexual harassment disputes.

To be eligible for Extended Legal Assistance the applicant must satisfy:

  • Clear Benefit Test.

Early Resolution Assistance is available to workers who have unlawful discrimination and/or sexual harassment disputes in the workplace or to seek a Stop Sexual Harassment Order.

Early Resolution Assistance is available to apply to and attend conferences, conciliations, or mediations at the Fair Work Commission.

Early Resolution Assistance is available to complain to and attend conciliations at:

  • Anti-Discrimination NSW, or
  • the Australian Human Rights Commission.

To be eligible for Early Resolution Assistance the applicant must satisfy:

  • Clear Benefit Test.

The ERA Means Test does not apply to these matters.
