8. Means Test determines contribution to adverse costs
8.1 Contribution determined under s36(1)(b)
If legal aid is granted subject to a condition that the legally assisted person make a contribution to any costs ordered against them, the Means Test is used to assess the amount of such contribution (see s 36(1)(b) of the Legal Aid Commission Act 1979).
8.2 The amount of contribution
The amount of contribution is calculated on the applicant's income and assets using the procedure set out in Means Test 7.3 Income contribution and Means Test 7.5 Total contribution.
