Policy Bulletin 2024/6 Apprehended Violence Order policy change

The CEO of Legal Aid NSW has approved changes to the AVO Policies to clarify when aid is available in AVO matters. 

Background

Legal Aid NSW has approved some minor changes to the AVO Policy to clarify that legal aid is available to make or defend variation and revocation applications.

The changes do not expand existing policies, but rather ensure consistency and reflect current practice.

    The changes to the AVO Policy include:

    • clarifying in the policy that aid is available for revocation and variations, and
    • using the language “protected person” and “defendant” to minimise the potential confusion caused using the term “applicant”.

    A consequential amendment was also made to 2.2.1 Local Court Crime duty service policy to reflect that the AVO policies are now standalone. 

    The changes were published on 25 June 2024.
