Types of grants of aid guidelines

These are the guidelines to the Types of grants of aid policies and are intended to be read with those policies. The guidelines provide guidance on how the policies are to be applied by setting out certain requirements which need to be observed when administering grants of legal aid.  

6.1.1 -  Procedures for approving emergency grants to private practitioners


Legal Aid NSW staff must tell the private legal practitioner at the time of the emergency grant:

  • the extent of work which will be covered by the grant;
  • what contributions, if any, are payable by the client; and
  • the conditions attached to an emergency grant as set out in clause 2.3.

Legal Aid NSW staff must send the private solicitor a letter confirming the emergency grant, including all the information set out in the previous paragraph.

Legal Aid NSW staff must send the legally assisted person:

  • a copy of the letter forwarded to the private solicitor
  • a letter telling the legally assisted person of their right of appeal against the conditions of the grant under s56 of the Act.
