Policy Bulletin 2020/6 Crime Policy: applications to remove driver disqualifications

The Legal Aid NSW CEO has declared that from 1 July 2020 legal aid is not available for applications to the Local Court to remove driver licence disqualifications under Division 3A of Part 7.4 of the Road Transport Act 2013 (NSW).

Background

In September 2017, the Legal Aid NSW Board approved a new eligibility policy to provide aid in Local Court applications to remove driver licence disqualifications (Criminal Law Policy 4.3.6).

Legal Aid NSW was funded for three years to provide legal representation as part of the NSW Government’s reforms under the Road Transport Amendment (Driver Licence Disqualification) Act 2017 (NSW). The scheme enables a disqualified driver to apply to the Local Court for an order removing his or her current driver disqualifications.

Legal Aid NSW will not be funded in relation to this scheme beyond 30 June 2020.

Commencement date

The change applies to applications for legal aid determined on or after 1 July 2020.
